TERMS AND CONDITIONS

Terms and Conditions:

Sandlappers is not responsible for any items left in chairs or on chairs at time of pickup.

Free delivery and pickup on all orders over $25.00, otherwise a $10.00 fee applies. We will deliver to your rental unit the day of your check-in and pick-up the day of your check out. You do not need to be present. Please have all items available at the same location in which they were delivered no later than 8:00 a.m. the day of your check-out. Re-visiting the location a second time will result in a $25.00 fee being charged to your credit card.

If you are renting items from other companies please separate theirs from ours to avoid confusion as some of our items are similar and should we not receive our items upon pick-up you are charged their respective replacement values.

Same Day Order Fee:

Additional Items upon Check in:
We recommend making all additions to your equipment order prior to your check in day to guarantee availability. If you need extra items after your initial delivery, we require a minimum order of $25.00 for free delivery. If your additional items are less than $25.00 a delivery fee of $10.00 will be added to your rental request.

Linen Orders:
It is your responsibility to ensure you order correct ‘the first time’. Once you check in and ‘discover’ you need to ‘exchange’ a sheet set or two because you ordered incorrectly, etc, we do not ‘exchange’ sheet sets, you are charged for the new sets and the ‘Same Day Order Fee’ and ‘Minimum Order Delivery Fee’ applies. It is important you order correctly. All Linen orders must be placed online to ensure you are ordering what you want. Please understand, these are the least expensive items that we rent and we cannot afford to run a person and gas in our vehicles for free. Be sure you check with your rental company for the exact bed specifications before ordering.

Instructions are placed in each laundry bag as to what to do with linens.

Our laundry is commercially cleaned and folded and while the service works hard to ‘filter out’ by hand any stained sheets or towels, they will miss some. Please remember the items are CLEAN. We will exchange out any stained items you have if notified by Noon the next day after check-in, otherwise, all items are deemed ‘acceptable’.

Bicycles:
We do not supply helmets and such. We do not supply them mainly because of ‘sanitary’ situations. I surely wouldn’t want to wear a helmet, regardless of how much Lysol has been sprayed on it, that’s been worn dozens of times by other heads. A Walmart is in Shallotte and is only 15 minutes away for you to purchase one. We reserve the right to exchange a 26” for a 24” based on reservation demands as both are still ‘adult’ bicycles and it has nothing to do with the frame size more so than seat adjustment. We do have bike ‘trailers’ available, but not toddler seats. Toddler seats are DANGEROUS. Just think if you fall down, so does your toddler and it’s an abrupt fall. I know, I witnessed one once. It looks ‘cute’ and ‘cool’, but it’s really not.

Payments:
We require pre-payment for all orders, either by mail or by phone, to ensure availability of inventory and reserve yours. Checks accepted, but not within 14 days of arrival, however, we still require a credit card on file for security.

Cancellations:
Cancellations without penalty must be made two (2) weeks prior to arrival. Cancellations made within two weeks prior to your arrival will have a 25% ($10 minimum) fee assessed. Upon arrival we cannot offer refunds, but we will be glad to make exchanges for items of comparable value. On or after your reservation date we will be unable to refund any money. We will be glad to exchange your reserved rentals for another item of equal or greater value. You will be responsible for any additional fees if you select a higher priced item.

Your Responsibility of the Rental Merchandise:

We ask that you take care of it as if it were your own. You are FULLY responsible for the items while they are in your care. Merchandise that is stolen, lost, damaged, misplaced, etc, you will be REQUIRED to pay the full replacement cost of the item(s) and your card will be charged accordingly. Equipment must be returned in operable condition, normal wear and tear excepted. While we know it’s not a perfect world, and things will sometimes break, we just ask that you use common sense. We ask with Umbrellas, that you lower them when un-attended. In the event of high winds 15 m.p.h. and above we will NOT set up umbrellas for safety concerns and we ask that you do likewise. When raising an umbrella, you might need to ‘fluff’ it, as the folds will sometimes wrap around and if you try and ‘man-handle’ and FORCE the umbrella up, you run the risk of damaging the ‘cage’ of the umbrella and that’s $75.00 to replace the cage.

*Daily set-up and Take Down Service

If due to inclement weather, we are not able to set up your umbrella for you, you will be given a pro-rated refund of that day’s SERVICE, not the product. Daily Set-up is NOT included on the check-in date, as check-in’s are typically late, and take down service begins at 5 p.m. Umbrella rental is required for this service. Any other items that you may have rented will be at your rental unit the day of check-in. With use of this service we will contact you to establish a ‘point of set-up’ that is convenient for you, typically within 50 yards of the public beach walkway or your private walkway. During high winds, you will probably find your umbrella lowered for safety, however, umbrellas are very easy to raise. We do ask that if you leave the beach, to please lower your umbrella for safety purposes. Set-up and take down for chairs are available, but you must have the umbrella service for the chair rate to apply.

Refunds apply as follows for inclement weather:

Refunds on Set-up and Take Down Service
Management reserves the right to not set up even if not raining due to forecasting by weather service and conditions. For example, if it’s thundering outside, I will for safety reasons not endanger my staff by installing a lightning rod, I would prefer to refund your money for that day’s ‘service’, NOT THE PRODUCT RENTAL. Please understand it’s no more different than renting a car, you might let the car sit for two days and not drive it, but you are still paying for the car, driven or not. Same thing applies to rental items.

Instructions for Gas Grills and Charcoal Grills Gas Grills:

Gas Grills

Please use only in a well ventilated area and in accordance with the local ordinances and laws regarding the use thereof.

1. Open hood, turn gas on at tank, turn and press burner and press igniter, unit may take 2 to 3 seconds to ignite depending on wind conditions.
2. If unit does not ignite, please leave hood open and wait 2 minutes or more to allow gas to dissipate, and attempt to relight again.
3. AT NO TIME SHOULD THE HOOD EVER BE CLOSED DURING THE LIGHTING PROCESS.
4. When through grilling, be sure to turn all burner knobs to the off position and turn the gas tank valve clockwise to turn off.
5. Follow all manufacturer’s instructions in the lighting and care.
6. Do NOT leave grill un-attended for any reason.
7. Do not use on the beach, it is against the law.

Charcoal Grills

1. Use only in a well ventilated area and in accordance with the local ordinances and laws regarding the use thereof.
2. Use only charcoal or other approved items for a charcoal grill, i.e. wood chunks if smoking meats and such.
3. Use only approved fuels for lighting the charcoal, DO NOT USE GAS!
4. Do NOT dispose of ashes in the trash, let ashes accumulate until cool or overnight.
5. Do NOT leave grill un-attended for any reason.
6. Do not use on the beach, it is against the law.

Kayaks:

While kayaking is a wonderful and enjoyable experience, you are encouraged to use caution. Kayaking in the waterway is pleasurable probably more-so than the ocean as you have calmer waters. If you are inexperienced in kayaking, it is suggested you stay in calmer waters, i.e. the backwaters of the waterway, or canals. Riding ocean waves and such takes skill and it’s a learning experience with the probability of wipe-outs occurring riding waves in, and even when you learn how to do it properly, you will still have an unpleasant experience once in awhile. Just a rule to remember, ALWAYS have your lifevest on, and in the waterway, steer into waves (wakes) created by boats. If you tip over, don’t panic. It sometimes happens. It is suggested you visit some websites with videos to get the ‘basics’ of proper kayaking as we too want you to have a fun and enjoyable experience but more importantly, a SAFE one.

Linens and Other Items:

They will be dropped off outside your door in heavy duty laundry bags. Upon checkout, please be sure to place ALL linens in bag and PLACE OUTSIDE YOUR DOOR. Failure to leave linens outside will result in a $50.00 charge to your credit card for a re-delivery fee as we will have to make extra effort to have them picked up.

The undersigned, for myself, my personal representative, heirs, next of kin, successors and assigns, do:

(a) Hereby release, waive, discharge and covenant not to sue Sandlappers Beach, Supplies, LLC, herein referred to as SBS, it’s officers, registered agents and officials. Furthermore you RELEASE SBS for any and all damages for bodily injury, death or damage to property.

(b) Hereby agree to indemnity and save and hold harmless the releases and each of them from any loss, and liability damage.

(c) The undersigned expressly acknowledges and agrees that some of the rental items are dangerous, i.e. gas grills and charcoal grills, and can involve the risk of serious injury and/or death and/or property damage. The undersigned further expressly agrees that the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by the law of the Province or State in which the rental is conducted and that is any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full force and effect.

(d) Hereby assume all responsibility for and risk of bodily injury, death or property damage due to the negligence of releases or otherwise while in or upon the rental area and/or while operating or riding on or for any purpose participating in the rental.

(e) Hereby agree to fully reimburse SBS for all loss or damage, other than reasonable wear, resulting to/from the rental equipment I am provided, including the loss of rental income incurred by said loss or damage and attorney’s fees resulting from collection damages and lost rental income.

LEASE AGREEMENT

1. Leasee agrees to pay the rental rate specified for each item leased hereunder for each time period or fraction thereof that the rental property is charged to the possession of the Leasee.

2. Leasee agrees to pay rental charges in advance.

3. Leasee agrees to return the rental property of SBS immediately upon termination of this contract in the same condition in which property was received, normal wear and tear excepted.

4. Leasee agrees to immediately cease using any rental property if property is found to be unsafe or in disrepair. Leasee shall notify SBS immediately in either such case, and SBS agrees to replace the rented property with similar property in good working condition with reasonable dispatch. Rentals and other charges under this lease shall continue at all times pending such replacement and thereafter, in accordance with the terms of this lease.

5. Leasee agrees to pay all cleaning, repair and replacement charges on any rented property which is required upon it’s return to SBS.

6. Leasee agrees to pay SBS in full for all loss or damage to the rented property whether such loss is caused by theft of the rented property, or by reason of accident, or by careless or abusive use, or any other reason.

7. Leasee agrees to hold harmless and indemnify SBS and it’s owners, agents, and employee’s for any injury, loss or damage to any person or property, related to the use of this property. Leasee accepts full responsibility for any and all such damage and or injury that may result.

8. SBS makes no warranties of safety for use, merchantability, fitness for a particular purpose or any other warranty, expressed or implied with relation to the rented property.

9. ALL CHAIRS HAVE A WEIGHT CAPACITY OF 240LBS. exceeding this can bend the frames or tear the fabric, while normal wear and tear is expected and accepted by SBS, you are responsible for the cost to repair or replace any item.
